In the Name of God Amen
John Baron Vicars of Lostwithiel in the County of Cornwall and Chaplain of H.M.S. ffame declare this to be my last Will and Testament hereby revoking all former wills. First I make and constitute my dear Mother Mrs. Catherine Baron of Lostwithiel my whole and Sole Executrix and to her I give all I have and die possessed of to have and to hold for her whole and Sole use and benefit and if it should so happen that my said dear Mother does not dispose of my little meadow during her natural life which she is at full liberty to do I will that my dear Brother may succeed her in the possession of it. Secondly I wish my dear Brother to have my watch and Seals &c. Gun ffishing Rod. if worth his Notice and in fact I ardently wish him to have all I have after my dear Mother provided it is not disposed of as above by her also all my books ffurniture Plate China &c. &c. &c. Thirdly I beg my dear Mother to give my Brother all she intended to give me; also entreat my dear Uncle to do the same well knowing that my dear Brother is most deserving and will make a good use of the same, if my dear Uncle will accept of any thing in remembrance of a Nephew who loves him as well as ever Nephew loved an Uncle I beg my dear Mother to give to him several little things belonging to me for the above purpose. If I should die on board this Ship I beg and desire that Captain Bathurst will cause my drawers and boxes to be well secured and ??? and to be kept on board this Ship until he return to England then to be sent to my dear Mother at Lostwithiel by the waggon after being carefully booked(?). I give to my dear Mother all my pay that may be due to me as also all the monies due from Lostwithiel and whatever money my Agent at Lostwithiel may have or shall have of mine and my dear Mother will duly receive the same. As to my remains after I am dead if I die at Sea I beg to be decently thrown over board as usual with a large bag of sand (not shot). If however in harbour I beg that some hands may be sent on shore to dig a grave any where on the sea shore and to be laid in it as Circumstances will allow. I desire nothing to be placed in remembrance of me.
In Witness hereof I hereby sign my name declaring this to be my last Will and Testament the 28th. July 1813. John Baron, Chapn. ffame July 28, 1813
In the prerogative Court of Canterbury In the Goods of the Revd. John Baron Clerk deceased. The 25th. day of July 1816 Appeared Personally Catherine Cooban(?) of Lostwithiel in the County of Cornwall Widow and Phillippa Wade of the same place Widow and made Oath that they knew and were well acquainted with the said Reverend John Baron Clerk late Vicar of Lostwithiel aforesaid and Chaplain of His Majesty's Ship Antelope at Sea deceased and also with the manner and character of handwriting and subscription by having frequently seen him write and subscribe his name to writings and having now with care and attention viewed and inspected the paper writing hereunto annexed purporting to be & contain the last Will and Testament of the said deceased the said Will beginning thus "In the name of God Amen I John Baron vicar " ending thus my last Will and Testament this 28 July 1813" and thus subscribed "John Baron Chapn." ??? those depondents depose and swear that they do verily and in their consciences believe the whole body ??? and contents of the said paper ??? beginning ending and subscribed as aforesaid to be all of the proper handwriting and subscription of the said Revd. John Baron Clerk deceased. Catherine Cooban(?) Phillippa Wade. Same day the said Catherine Cooban(?) and Phillippa Wade were duly sworn to the truth of this affidt. by virtue of the ??? Commission before me JOhn Bower(?) Commissioner.
Proved at London 9th. August 1816 before the Judge by the Oath of Catherine Baron Widow the Mother the Sole Executrix to whom admon was granted being first sworn by Commission duly to administer. Detail Prerogative Court of Canterbury wills, 1384-1858, PROB11/1583/39/35 (TNA), dated 28 Jul 1813
